MARCO NORMATIVO: nubix3d respeta los derechos de propiedad intelectual de terceros de la misma manera que espera que se respeten los propios. Conforme al Título 17 del Código de los Estados Unidos, Sección 512(c) (DMCA), los titulares de derechos de autor o sus agentes autorizados pueden remitir avisos de infracción a través de nuestro Agente Designado.
1. Notificación de Infracción y Solicitud de Retiro (Takedown Notice)
Como proveedor de servicios de internet y plataforma de visualización digital, nubix3d se encuentra facultada para acogerse a las disposiciones de inmunidad («puerto seguro» o Safe Harbor) previstas en la DMCA. Para remitir una notificación de infracción de buena fe, la comunicación debe incluir los siguientes requisitos:
- 1. Firma física o electrónica del titular de los derechos de autor o de la persona debidamente autorizada para actuar en su representación.
- 2. Identificación de la obra protegida por derechos de autor que se alega ha sido infringida.
- 3. Identificación precisa del material presuntamente infractor cuya eliminación o bloqueo de acceso se solicita, suministrando la URL exacta o datos suficientes que permitan a nubix3d localizar el contenido en el Sitio.
- 4. Información de contacto suficiente del reclamante: nombre completo, dirección física, número telefónico y dirección de correo electrónico.
- 5. Una declaración expresa de que la parte reclamante tiene la convicción de buena fe de que el uso del material denunciado no está autorizado por el titular de los derechos, su representante o la ley.
- 6. Una declaración bajo pena de perjurio de que la información contenida en la notificación es verídica y de que la parte reclamante está legalmente autorizada para actuar en nombre del titular de los derechos de autor.
Advertencia Legal (17 U.S.C. § 512(f)): La ley federal establece sanciones civiles y pecuniarias, incluyendo costos procesales y honorarios de abogados, contra cualquier persona que a sabiendas y de forma sustancial tergiverse información o declare falsamente una infracción en una notificación DMCA.
Envío y Divulgación: Remita sus solicitudes a legal@nubix3d.com o a través del formulario de contacto oficial. Al presentar un reclamo, usted acepta y entiende que la identidad y los datos de su notificación podrán ser transmitidos al presunto infractor para los fines correspondientes.
2. Contra-Notificación y Restablecimiento de Material
Si el usuario ha recibido una notificación de remoción de contenido y considera que el material fue retirado por error o identificación equivocada, puede presentar una Contra-Notificación formal con arreglo a 17 U.S.C. § 512(g)(3), conteniendo:
- 1. Firma física o electrónica del usuario.
- 2. Descripción del material eliminado y la ubicación o URL en la que se encontraba alojado antes de su remoción.
- 3. Declaración bajo pena de perjurio de tener convicción de buena fe de que el material fue retirado o deshabilitado debido a un error o confusión en su identificación.
- 4. Nombre, dirección física y teléfono del usuario, junto con una declaración de sometimiento a la jurisdicción del Tribunal Federal de Distrito correspondiente al domicilio del usuario (o de cualquier distrito judicial donde se encuentre nubix3d, si radica fuera de EE. UU.), aceptando recibir la notificación de actos procesales del reclamante original.
3. Política sobre Infractores Reincidentes
nubix3d mantiene una política estricta de tolerancia cero ante la violación reiterada de la propiedad intelectual. En cumplimiento de las disposiciones de la DMCA, registramos las notificaciones formales recibidas y procederemos a la cancelación inmediata de cuentas o acceso a la plataforma de aquellos usuarios categorizados como infractores reincidentes.
nubix3d se reserva el derecho de modificar el contenido de esta política en cualquier momento. Se recomienda su consulta periódica.
LEGAL NOTICE: nubix3d respects the intellectual property rights of others just as we expect others to respect our rights. Pursuant to the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright owner or their authorized agent may submit a takedown notice to our Designated DMCA Agent.
1. Notice of Infringement – Takedown Claim
As an internet service provider and digital viewer hosting platform, nubix3d is entitled to claim immunity from copyright infringement claims pursuant to the «safe harbor» provisions of the DMCA. To submit a good-faith infringement claim, you must submit a written notification setting forth the following elements:
- 1. A physical or electronic signature of the copyright owner (or someone authorized to act on behalf of the owner).
- 2. Identification of the copyrighted work claimed to have been infringed.
- 3. Identification of the infringing material to be removed, and information reasonably sufficient to permit nubix3d to locate the material (please include specific URLs to assist in prompt identification).
- 4. Information reasonably sufficient to permit the service provider to contact the complaining party, including legal name, physical address, email address, and phone number.
- 5. A statement that the complaining party has a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
- 6. A statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.
Statutory Penalty Notice (17 U.S.C. § 512(f)): Any person who knowingly and materially misrepresents that material or activity is infringing may be subject to substantial civil liability, including damages, court costs, and attorney fees.
Submission and Disclosure: Send all takedown notices to legal@nubix3d.com. By submitting a claim, you accept and agree that your identity and infringement notice may be communicated to the alleged infringer.
2. Counter Notification – Restoration of Material
If you have received a notice of material being taken down due to a copyright claim, you may submit a formal Counter Notification pursuant to 17 U.S.C. § 512(g)(3) containing:
- 1. Your physical or electronic signature.
- 2. A clear description of the material that was removed and the original location/URL where it appeared prior to removal.
- 3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- 4. Your name, address, and telephone number, together with a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or of any judicial district in which nubix3d may be found, if residing outside the US), and that you will accept service of process from the original claimant.
3. Repeat Infringer Policy and Modifications
nubix3d strictly enforces a repeat infringer policy. We maintain an internal registry of DMCA notifications and will terminate account access or service agreements with any users determined to be repeat infringers.
nubix3d reserves the right to modify this DMCA policy at any time for any reason. Periodic review by users is strongly recommended.
